South Australian state MP Sam Duluk accused of sexual harassment, racism, and homophobia by Greens MP under parliamentary privilege

Using parliamentary privilege, South Australian Greens upper house MP Tammy Franks yesterday made a number of allegations against Waite MP Sam Duluk, a former Liberal who is currently an independent politician, in the Parliament of South Australia.

In response to the allegations, Duluk claimed he was "astonished that Ms Franks considered it appropriate to exploit parliamentary privilege to attempt to destroy my character and I invite her to make these assertions without the protection of parliamentary privilege", and called Franks' allegations "salacious and designed to cause maximum political damage".

Duluk was acquitted in August 2021 of assault after it was alleged that he touched MP Connie Bonaros on the backside at a December 2019 Christmas party at Parliament House in Adelaide. Franks alleged that, during a Liberal Party Christmas function held at the same time at Parliament House, there was video footage of Duluk "calling a female staff member a 'frigid bitch'".

Franks claimed that, during the same function, "a staffer who was accompanying, and with, the Member for Waite [Duluk] at the time urinated in a corner of an MP's office before turning around with his penis still exposed, waving his appendage into the breeze with his arms in the air, calling out: 'Touch it, touch it.'"

Franks made these allegations as a result of the end of a parliamentary investigation into Duluk's behaviour at this Christmas party, saying "I note that with the ending of the Speaker's inquiry, this matter and those victims now have nowhere to go." Franks also added "so let us put on record some of what I understand are the actions which the Speaker's inquiry will no longer hear".

In addition to the allegations of misbehaviour at the Christmas party, Franks made a number of additional claims. She stated that Duluk had "said to a woman in this workplace, our workplace, her workplace, 'You've got big a cuss word for breasts.' Then he said, 'I'd like to a word starting with F, with four letters, them. He said to a woman in this workplace, our workplace and her workplace, 'I know you're eff-ing him so you can eff me too.'"

Franks also alleged what she called "racist remarks" from Duluk, saying he had said of another MP that "he is not a real Aboriginal. My grandmother was raped in Mildura so maybe I am part Aboriginal." Franks claimed that Duluk had asked another staff member if she was having sex with her, and "further asked that worker if myself and this woman were lesbians."

Franks accused Duluk of "homophobic treatment" of a male parliamentary worker, saying that the worker "had his jacket repeatedly seized and repeatedly attempted to be pulled off him", and was later "subjected to further homophobia after deciding to leave the corridor drinks, adding to the bullying, rudeness and indignity he had already faced, when the Member for Waite [Duluk], walking several paces behind him with a Liberal staffer, mused loudly enough so that those behind the Member for Waite in the corridor could hear, 'Best not walk too fast and get ahead of him or we might get fucked up the arse'."

Sam Duluk's membership of the Liberal Party was suspended in February 2020, after Liberal Premier Steven Marshall declared Duluk's position in the Liberal party room as "untenable". A representative of the Premier told InDaily yesterday that Marshall "maintains his position that [Duluk's] behaviour was offensive and unacceptable".
