That would be due to the fact that, as of the time this article was written, he was *charged* not *convicted*. I'm honestly not looking to defend any ideological positions, particularly those based on bigotry, ignorance, and persecution, but the fact of the matter remains that it is far from an impossibility that this altercation was the result of factors completely unrelated to the sexual identity or orientation of any of the participants. That said, it is also a possibility that said factors were the cause of this particular incident. Therefore, the accused is *charged* with violating X law. This prompts the court to investigate whether these charges are true. If they find that they are, then the accused will *convicted* and be deemed guilty of violating X law.

This all taken into consideration, the charges of assault look to be a given instance of guilt. However, it would be unfair and unjust were one to decide this prior to the presentation of all available evidence and information.

A hate attack. Sounds about right.

Given what is established on the article his definitely seems like a hate attack to me, this proves to me that there is little hope for the younger generation of today. As an 18 year old myself I can say that it makes sense that if someone was having an affair with someone's sister they would be mad but nevertheless to leave her with injuries that wold put her in hospital is still way too out of order, the worst part is the judge will probably give him a lower sentence because he is 18 and has the rest of his life planned, a restraining order on him to not go near the non-family one is the way to go on this in my opinion. Am I too leniant perhaps? thoughts?

I feel the need to point out that judging an entire group of people, regardless of the given group or ones inclusion therein, based on the actions of a number of units less than the entirety of the given group is the cause of hate crime in general.

In regards to this case itself, I do not personally feel that enough evidence has been provided to me to convict this man of a hate induced crime, but an investigation into that possibility is certainly called for.

I'm not entirely sure if your second sentence is intended to be outlining an alternative scenario, though if not I would point out that this article says nothing regarding an affair. The only facts established regarding the nature of the relationship is that they are both romantically involved with one another, and both female.
