Fair use vs. free use[edit]

Are IRIN images "Fair use" or, rather, are they images that are freely licensed? --Chiacomo (talk) 04:28, 22 July 2006 (UTC)Reply

Actually, a discussion about this was raised in #wikipedia. They decided that it could be free use. —this is messedr͏ocker (talk) 04:28, 22 July 2006 (UTC)Reply

So it's not really "Fair use", but something else? The reason I'm asking is that we shold always replace Fair Use images with free images when one is available -- IRIN photos, on the other hand, needn't be replaced. --Chiacomo (talk) 04:32, 22 July 2006 (UTC)Reply

w:User:Zscout370 said on IRC of the matter:
<Zscout370> IRIN is not a free source
<Zscout370> since they disallow "adaptation" of their works
(reprinted with permission)
Additionally, there's been discussion of this on Commons: [1]. I think we can safely say that this is fair use, and that we'll continue to use it as fair use. —this is messedr͏ocker (talk) 06:05, 22 July 2006 (UTC)Reply

They're not "free free", but the images also don't meet the definition of "fair use" as their use is specifically allowed by IRIN in news publications such as ours. It is important to tag them since we use them under a grant of license contained on IRIN's copyright page -- our readers and possible content re-users should be aware of the restrictions on the use of the images. In addition to listing the source and the license by which we reprint the photographs, we should credit IRIN in the caption of any photo we use (and I think we have done so in the past).

In summary, no, they're not "free images" (and can't be uploaded to commons, for example), but they're not "fair use" either. --Chiacomo (talk) 06:38, 22 July 2006 (UTC)Reply
