A rationale outlining why the media in question qualifies for an exemption under Resolution:Licensing policy:

That is not reasonable. We are not here to force anyone to make their own images. The image is available, and is licensed properly and is compatible with Wikinews. And no one has yet to tell me any reason why its not.The fair use is there. And its not on commons nor is a map. And if you start telling users to make their own images, you may as well tell them to take a hike too. DragonFire1024 08:07, 16 May 2007 (UTC)[reply]

Fair Use and Wikinews[edit]

The major failing of the policy with regards to Wikinews is a failure to take into account our time constraints and the focus of our users on writing. We have an archiving policy, and as far as I am concerned this image was fair use at the time the associated article was published. I could live with a {{depreciated}} or {{superceded|foo}} tag and asking commons for help with images, but if they can't replace the image within our pre-archiving window I see no reason why we shouldn't keep using the image on that article.

Personally I think it is ridiculous to suggest that our users should be squandering their time with photoshop to replace a map provided under Crown Copyright. Our project hasn't attracted the people who carry out these tasks and if they have set up any framework to do this work for sister projects elsewhere (Eg commons) they've hidden it well.

We already hold ourselves to a higher standard than many of the mainstream press, this map likely appeared on many sites without any credit. I understand the frustration of some who object to the encyclopedic interpretation of the new policy. As far as I'm concerned for an image like this you claim Fair use, and if it isn't replaced within 240 hours then tough luck, it was fair use for the life of the article. If someone comes along 241 hours later and uploads a more free image then the image used should be tagged to avoid future use.

Some of the comments I have seen regarding the dispute over this issue have constituted personal attacks and threats. Some of the involved parties who are not so active on this project need to accept that our non-encyclopedic nature means there are different interpretations of the policy here. On the other hand, some of those who are unhappy with the proposal are failing to assume good faith. Can we stop the foot-stomping and threats and have a serious discussion about this one image? Fair Use Rational: The entire portion of the Crown Copyright image is used and taken directly from the above source with no modifications. This image is being used to show an exact location or visual identification of the British Embassy in Tehran, Iran. It illustrates the particular topic of where shots were fired outside the British embassy in Tehran during the hostage crisis of the 7 British sailors being held captive in Iran. This image has not been uploaded in a lower resolution from the original. This image is an exact location of the embassy and no other "free" image exists under the guidelines of "free." This image could not be recreated without the use of copyrighted material/maps.

Calm Down![edit]

I think we need to start a fresh and, calm down! I happen to agree with DragonFire1024 because he has followed all the minimum requirements and, has in general responded appropriately to any criticizm.
