User:Florentino Floro/Learned Treatise:Legal-Academic Values of Compleat User Page

From Wikinews, the free news source you can write!
This policy in a nutshell This policy in a nutshell:
This Wikipedia:Subpages states that User:Florentino Floro was created and continuously edited, in order that his created articles may be accepted and taken judicial notice of, by courts and cited by lawyers in their Brief (law), and incorporated in thesis defense, as Learned treatise.

User:Florentino Floro' Wikipedia:User Page was and is continuously designed under Wikipedia:User Page Design Center/About you. The most important function of my user page is - it is a great way to enable me to introduce myself to the Wikipedia community. As people get to know each other better, it (usually) becomes easier for them to work with each other, and this helps create a sense of community. As with every aspect of user pages, users' coverage of themselves is highly unique and may span many different areas.

This / my userpage is not my biography and it is not my/a blog. More importantly, and I stress, this / my user page is not a -

However, it contains terse but plenty of information that people-editors will find interesting, including:

  • Where I live, etc.
  • What I do in my meatspace (so-called "real life")
  • What my interests are

Wikipedia:Wikipedians with articles-Category:Notable Wikipedians

[edit]

User:Florentino Floro is Florentino Floro, and is listed in a very short list of Wikipedia:Wikipedians with articles. NOTE that there are more than 100,000 Wikipedia editors, and User:Florentino Floro is listed in the Category:Notable Wikipedians.

Sources and tools

[edit]

I started creating, little by little, this user page by: looking, regularly (since I created this page and contributed to Wikipedia on July, 2007, until I contributed more than 6,000 edits, visiting more than 200 User Pages of administrators and editors, plus, picking-copying choice cuts-parts from their user pages) around other people's-editors'-administrators' userpages. I also regularly found a lot of pictures of people's cats and dogs, charts of which countries the editors have visited, and other 'unencyclopaedic' miscellanea.

I use these Wikipedia tools and policies to create and continously amend my user page:

Ownership and editing of pages in my user space

[edit]

Wikipedia:Userpage states "Wikipedia offers wide latitude to users to manage their user space as they see fit". It adds: "Generally, the question is proportionality. If you spend a lot of time helping build the encyclopaedia, then no-one will mind if you spend some time on your userpage as well. If your userpage contains lots of information about how you can be of help (see Expertise), then a picture of your stick insects could set it off nicely."

It further adds: "The issue of how much personal information is tolerable and how much is 'Myspacing' (a derogatory term for using a userpage as a social networking tool instead of as a means to help write Wikipedia) can be controversial, particularly since userboxes allow editors to display a massive amount of personal information with little time or effort; encouraging the presentation of personal information that users simply wouldn't bother to write an actual paragraph about.

It furthermore states: "If someone criticises your use of your userpage, keep cool. Editors can and do remove material from your userpage if there is a consensus that it hinders the writing of the encyclopaedia (see Wikipedia:User page's section on this).[1]

My user page philosophy

[edit]

"Show the door to trolls, vandals, and wiki-anarchists, who, if permitted, would waste your time and create a poisonous atmosphere here." Larry Sanger - Wikipedia:Etiquette I share and copy, as my own Wikipedia philosophy - SimonP Aka Simon Pulsifer, was born on September 11, 1981, in Halifax, Nova Scotia, and has been referred to as the 'King of Wikipedia' in the Canadian media. He is a prolific editor of the English-language Wikipedia: Pulsifer explained his devotion to Wikipedia as follows:[2] "It's important that people around the world have access to free, accurate and unbiased information. Wikipedia tries to do that, and it's a very honourable and admirable goal."

The rules says "Other users cannot edit my user page without my permission"

[edit]

WP:UP#OWN provides: "In general it is considered polite to avoid substantially editing another's user page without their permission. Some users are fine with their user pages being edited, and may even have a note to that effect. Other users may object and ask you not to edit their user pages, and it is probably sensible to respect their requests. The best option is to draw their attention to the matter on their talk page and let them edit their user page themselves if they agree on a need to do so. In some cases a more experienced editor may make a non-trivial edit to your userpage, in which case that editor should leave a note on your talk page explaining why this was done. This should not be done for trivial reasons."[3]

My expertise

[edit]

My expertise in editing is so simple. I desire to put forth in this / my user page, a succinct description of my capability, professional and scholarly endowed gifts, to contribute to Wikipedia, such that readers and researchers can use my created articles, cite them in thesis, court pleadings, briefs, memorandum, appeals, and quote my works, to support judgments, thusly:[9] One of the most important uses of my userpage - if not the most important - is for me, to let editors and readers of my articles, know of my skills and areas of expertise.

Languages

[edit]

These are the languages I speak: Filipino, English, Spanish; I understand and read Latin. I am hereunder displaying my linguistic capabilities by means of availing of one of the most popular uses of userpages. The result: other editors will know if I can translate something for them, but this isn't just limited to interwiki translation. Sometimes sources for English-language articles are written in a foreign language, and Wikipedians may need someone to help them work out what they say. Vide: In other tongues[10]

Other areas

[edit]

Educational and professional qualifications

[edit]

The rule provides" "The other areas of experiences you could display on your userpage are as diverse as the subjects of this encyclopaedia, but apart from areas you're generally interested in, you could list your educational and professional qualifications, ability in programming languages and skill with musical instruments. Many userboxes exist to show off your talents, and you can display them with the methods on Wikipedia:Babel and on Wikipedia:Userboxes. You don't have to use userboxes, however - often a well-written paragraph will may look better than a carbon copy of what someone else has."[11]

Presentation of Wikipedia problem of reliability

[edit]

On July 14, 2008, Philippines top TV GMA-7 top news-video, which I viewed, reported that: UST Dean prohibited UST students from using Wikipedia and other online Internet sources, due to easy to edit, thing. He on behalf of UST issued the statement that only hard copies of books with authors would be accepted as thesis. - User:Florentino Floro (talk) 09:47, 15 July 2008 (UTC)

Regarding this issue, teachers in UST and UP really do not allow their students to use/cite WikiPedia as their source. While we (you and me) believe that Wiki is reliable, WikiPedia has its disclaimer)Wikipedia:General disclaimer) that will drive others to not rely at all. I actually raised this issue last year in TAMBAY. - User:Efe (talk) 11:18, 15 July 2008 (UTC)

In thesis, of course, they are correct. But in legal briefs, memorandum, court judgments, oh! Wiki is very rich as far as legal articles or judgments are concerned. State of the art. They can be cited in our SCRA (Philippine Supreme Court Reports Annotated, counterpart of USA's CJS, AmJur & ALR). I don't know in science journals here. But the bio's of notable persons like Puno, can be cited in speeches. Schools are schools. They want their books to be bought. Ateneo, UP, UST, their Press is not competitive, since they force their students to buy books from their press. With Wiki online and internet onlines now, students rarely buy books for research, or thesis. This is my fight against WikiPinas babies. They are so unreliable, and the ads of Vibal's books to be bought... Who would cite WPinas? But Wikipedia, I bet, the Justices are the ones first using these in decisions. How much do justices now DO NOT HAVE TO SPEND for ALR, AM JUR, and CJS? (Each volume is $ 100+, and our SCRA is P 1,000+ Just open Wiki decisions of USA and bingo. There is no need to type but just copy paste from Wiki PDF in the links. I use Wiki legal articles for my memo, and I open the original PDF USA decision based on Wiki external links. In our court decisions, just open Supreme Court of the Philippines, go the the Ext. Link, open [www.supremecourt.gov.ph] you have the full decision, no need to buy SCRA. Wikipedia is reliable.-- Florentino Floro (talk) 11:56, 15 July 2008 (UTC)

We cannot really force them from the fact that we have a disclaimer. Its a challenge to us to further improve the project. Whatever they opine/claim about the site, just say. - Efe (talk) 12:03, 15 July 2008 (UTC)

Well, this is the first in Philippine education history that "just" a section of a (UST) school (of course UST College of Law would not) did issue a school circular and policy from using Wikipedia as source in subjects. I am new here in Wiki, and did not, yet, find any school here in Philippines and worldwide which did issue the same policy. At any rate, statistics cannot be disregarded, that, (because of Wikipedia's candid and straightforward notes/explanations of its reliability) 80% of Philippine and worldwide English/American schools, use Wikipedia English for research. --Florentino Floro (talk) 07:08, 16 July 2008 (UTC)

Let me add, that because of Wikipedia very scholarly written articles on USA recent and old USA decision since C.J. John Jay to C.J. John G. Roberts, jurists, lawyers and law students worldwide are spared, from buying ALR, AmJur, CJS, etc. I would say, there is nothing for Wikipedia to improve in the realm of legal articles. (Most recent SCRA decision by top Philippine Justices, source Wikipedia as most valuable tool in drafting Philippine decisions. Antonio Carpio started e-library (2005) using for sure Wiki. -Florentino Floro (talk) 07:08, 16 July 2008 (UTC)" (cf. User talk:Efe/Archive 11)[21][22]

Philippines corruption

[edit]

On January 25, 2005, and on December 10, 2006, Philippines Social Weather Stations released the results of its 2 surveys on corruption in the judiciary; it published that: a) like 1995, 1/4 of lawyers said many/very many judges are corrupt. But (49%) stated that a judges received bribes, just 8% of lawyers admitted they reported the bribery, because they could not prove it. [Tables 8-9]; judges, however, said, just 7% call many/very many judges as corrupt[Tables 10-11];b) "Judges see some corruption; proportions who said - many/very many corrupt judges or justices: 17% in reference to RTC judges, 14% to MTC judges, 12% to Court of Appeals justices, 4% i to Shari'a Court judges, 4% to Sandiganbayan justices and 2% in reference to Supreme Court justices [Table 15].www.sws.org.ph, New Diagnostic Study Sets Guideposts for Systematic Development of the Judiciarywww.sws.org.ph, New SWS Study of the Judiciary and the Legal Profession Sees Some Improvements, But Also Recurring Problems

The September 14] 2008, Political and Economic Risk Consultancy (PERC) survey, ranked the Philippines 6th (6.10) among corrupt Asian judicial systems. PERC stated that "despite India and the Philippines being democracies, expatriates did not look favourably on their judicial systems because of corruption." PERC reported Hong Kong and Singapore have the best judicial systems in Asia, with Indonesia and Vietnam the worst: Hong Kong's judicial sytem scored 1.45 on the scale (zero representing the best performance and 10 the worst); Singapore with a grade of 1.92, followed by Japan (3.50), South Korea (4.62), Taiwan (4.93), the Philippines (6.10), Malaysia (6.47), India (6.50), Thailand (7.00), China (7.25), Vietnam's (8.10) and Indonesia (8.26).afp.google.com/article, Hong Kong has best judicial system in Asia: business surveywww.abs-cbnnews.com, Hong Kong has best judicial system in Asia: business survey

Billions lost by schools due to Wikipedia as thesis reference

[edit]

Gaspar Vibal's Vibal Publishing empire in the Philippines faced the worst corruption controversy in Philippine publishing. Amid the Department of Education’s controversy on recent textbook project, Vibal Publishing House Inc. admitted that it had “interlocking ownership” with an “affiliate,” the LG and M Corp, but denied accusations of being the leader of a cartel. Vibal and LG and M formed a consortium regarding the publication and delivery of 17.5 million elementary textbooks and teaching manuals for public elementary and high schools funded by P 800-million loan ($40 million) World Bank loan. Contracts were awarded in September, 2006 to Vibal and Watana Phanit, inter alia, despite a pending Supreme Court petition filed by losing bidders.services.inquirer.net, Vibal Publishing House: What cartel? University belt book-thesis cartel

[edit]

In Metro Manila university belt, especially in Recto, Manila, each thesis is sold for $20. Now, 90% of these school requirements would cite Wikipedia as reference. Then, authors, professors, and ultimately, book publishers lost the war to have monopoly of the huge chunk in college education bread and butter, thing. So, most universities lodged war against Wikipedia. The result, college students were forced to buy books from book stores who in turn bought from empires like Vibal Publishing.

My article, is the best evidence, that Wikipedia articles can be accepted as [[Learned treatise] despite the Wikipedia:Disclaimers, since my User Page, if read, would prove, that I am an authority on the subject, not just an expert. Ateneo Law School requires thesis for its Juris Doctor degree. And my article was used extensively by Ateneo students. I heard in a news, in GSIS-Meralco bribery case, that a thesis on this won $ 2,500.

Wikipedia Article, as Learned treatise

[edit]

The Philippines Revised Rules of Court was borrowed from the USA Federal Rules of Civil Procedure and Federal Rules of Evidence[23] [24] Sec. 46, Learned Treatise - was copied from Rule 529 of the USA "Model Code of Evidence" as Adopted and Promulgated By the American Law Institute at Philadelphia, PA. May 15, 1942 Philadelphia American Law Institute 1942[25] (Vide: page 371, Rules of Court in the Philippines, Justice Ruperto Martin, 1978 edition, Learned Treatises) "RULE 129 What Need Not Be Proved Sec. 2. Judicial notice, when discretionary. — A court may take judicial notice of matters which are of public knowledge, or are capable to unquestionable demonstration, or ought to be known to judges because of their judicial functions.(n) RULE 130 - Rules of Admissibility - Sec. 46. Learned treatises. — A published treatise, periodical or pamphlet on a subject of history, law, science, or art is admissible as tending to prove the truth of a matter stated therein if the court takes judicial notice, or a witness expert in the subject testifies, that the writer of the statement in the treatise, periodical or pamphlet is recognized in his profession or calling as expert in the subject. Necessity of complete information on Wikipedia editor-user-creator of the article-Learned treatise

The Court can take judicial notice of a Wikipedia article, as learned treatise, an exception to the hearsay rule, using its own discretion. However, like any thesis, a Wikipedia article on (judicial history, science or art), must be supported by the Wikipedia article's author-creator-user-editor's complete biodata-resume supported by Certified uploaded images of Court public documents, certificates, and the like: in the User Page. Jurists must be convinced, that the author of the learned treatise is not only an expert on the subject matter, but must possess excellence in the field, proved by documents.

"In his youth, Floro was an accomplished student, graduating with full honors in elementary, high school and college levels. He graduated: elementary (1965) from St. Mary's College of Meycauayan (6th Honors); high school (1970) from St. Vincent's Seminary, Karuhatan, Valenzuela City; he finished 2 semesters (1971) of Bachelor of Arts at the Vincentian Hills Seminary at Angono, Rizal and Adamson University (under the Vincentian Family / Congregation of the Mission priests, 3rd Honors); threat, upon the hills, in 1971, Floro predicted that he would someday be made world famous and immortal in world history; and college (1974)[27] , Bachelor of Arts, pre-divinity[28] and philosophy, from the Ateneo de Manila University, Loyola Schools (admitted as Pre-novice / candidate for priesthood by the Society of Jesus, with Second Honors).

Parenthetically, he was the sole Bulacan province student who was admitted by the Ateneo de Manila in 1972; Floro was the only Bulakeno who graduated from the Ateneo in 1974. More importantly, Floro excelled by topping the Fr. Parissi, S.J., 2 days mental tests (only 5 of 400 candidates were admitted in 1972 to the Jesuit Pre-Novitiate). He earned 18 MBA units in 1975 at the Ateneo Graduate School of Business. He earned the degree[29] of Bachelor of Laws (1982) at the Ateneo Law School, with[30]full second honors.[31] He made the 10 years unbroken (by 10 Ateneo valedictorians) record of 91% in criminal law review under Dean Antonio L. Gregorio.

He placed 12th[32] in the[33] 1983 Philippine Bar Examination, with a very high bar rating of 87.55%[34] in one of the hardest examination in Philippine history (only 21.3% passed; 65% of both Ateneo and University of the Philippines College of Law students failed because of the taxation bar subject).[35] Floro, from 1972-1974, and 1980, sat beside his classmates - Romeo Intengan (Philippine Jesuit, former Provincial, and surgeon by training, jailed during the dictatorship of Ferdinand Marcos for his views against the dictatorship - List of Jesuits) and Cesar L. Villanueva (Dean, Ateneo College of Law), respectively.

Floro also graduated (1975) basic and intermediate Equestrianism at the Philippines D'Rossa School of Horsemanship, at Makati City[36], but failed in his dream to become a horse race jockey. From 1975 to 1983, he regularly rode his own American Quarter Horse "Wimps Pansy" along Meycauayan to Marilao, Bulacan."

Raison d'être of my User Pages' length-philosophy - "Art and Soul"

[edit]

With fervent Wikipedia hope and dream some, if not all of my created articles and major edits, would be cited as authorities by court decision, lawyers' briefs (law) and in defense of thesis.[38]

I find the need to clarify, why I took pains, long hours and days to create my Userpage. First, Florentino Floro's reliable sources are just so few, and journalists worldwide, copied just 5 paragraphs of the 75 pages decision, which allegedly ruled I am psychotic and not insane. Thus, I had to inform all Wikipedia editors that what is told or said in Florentino Floro - is what journalists said, and not what is true based on Wikipedia approved reliable sources. Second, each line and paragraph of my Userpage, is supported with verifiable links, and I added humor, so that it will not be boring. How? Of course, I copies user pages of about 20 administrators. Third, in my talk pages from Archives 1-3, of more than 100,000 editors and 1,500 administrators, I failed to find more than 3 who would complain about my Userpage creation. I desire, that if readers and editors would read Florentino Floro and find that I edit Wikipedia, they will not be afraid of me/my articles / contribution, and since, allegedly since, I had been labeled psychotic. Also, 99% of us, Filipinos are Catholics/Christians, and under our, UK, and USA constitutions, our belief in angels and dwarves are protected by religious freedom. I am careful however on this, since I respect so much, skeptics, atheists, etc. Cheers.--User:Florentino Floro (talk) 11:53, 26 September 2008 (UTC)

With all due respect

[edit]

I started my Wikipedia:User page on 25 July 2007[39] At first, after some edits (of my present 6,010+), I slowly learned by copying some parts of Wikipedia:administrator's user pages. Then, I opened category of administrators, and 80% of my present user page is sourced from not less than 20 Wiki administrators' user pages. Then, I read the philosophy and policies of Wikipedia:User page, vis-a-vis, some editors' and admins' (of 100,000 Wiki editors and 1,500 Wiki admins) messages on this talk pages or on theirs, sharing to me their views on my user page and the policies.

Let me briefly quote some of these: "User:Titopao[40] First, what stays on the user page, stays on the user page. A user may choose to write a biographic user page (with perhaps plenty of userboxes and other stuff that might interest the user), or a user may choose to write a humorous or tongue in cheek entry. My user page is more or less biographic and, while it withholds some information about myself (for good reasons), it's still factual to the best of my knowledge. On the other hand, a user page that is clearly written humorously (however it looks like a "forgery"), needless to say, should be approached with the same light-hearted manner that the user intended it to be, and shouldn't be taken too seriously. You may, for one, decide to write something along the lines of "I had long wanted to win the Nobel Prize in Physics, but it looked like numbers didn't like me and even hated me to death, so I opted to pursue my other love, which is law and letters" and perhaps, with good reason, also include a disclaimer on the top that says you actually intend the user page to be humorous. Or you can write something along the lines of, "I am the handsomest guy in the whole Philippines with the most number of girlfriends in a single hour" and probably add a picture of..hmm, Brad Pitt?? :P"

Without images, our user pages would be without any breath. Regards.--User:Florentino Floro (talk) 11:18, 27 August 2008 (UTC)

My Philosophy of My Userpage

[edit]

Basically, I spent times, precious moments, to created my Userpage, since for me, this is my soul and spirit in Wikipedia. Let me quote some pertinent portions of Wikipedia:User page: "Ownership and editing of pages in the user space ... The Wikipedia community is generally tolerant and offers fairly wide latitude in applying these guidelines to regular participants. Particularly, community-building activities that are not strictly "on topic" may be allowed, especially when initiated by committed Wikipedians with good edit histories. At their best, such activities help us to build the community, and this helps to build the encyclopedia. As a tradition, Wikipedia offers wide latitude to users to manage their user space as they see fit.Article content policies such as WP:OR generally do not ... and try to assume good faith that they are merely trying to share information about themselves."

"Users with most of their contribution edits outside their user space should be given more leeway in this regard than users whose edits consist solely or mostly of user space edits. Your userpage is for anything that is compatible with the Wikipedia project. Think of it as a way of organizing the work that you are doing on the articles in Wikipedia, and also a way of helping other editors to understand with whom they are working. Some people add information about themselves as well, possibly including contact information (email, instant messaging, etc), a photograph, their real name, their location, information about their areas of expertise and interest, likes and dislikes, homepages, and so forth. You can use your user page to help you to use Wikipedia more effectively. Another common use is to let people know about your activities on Wikipedia, and your opinions about Wikipedia. You might want to add quotations that you like, or a picture, or some of your favorite Wikipedia articles or images (freely licensed only – see the What may I not have on my user page? section below), or the like. Others may also edit your user page, for instance awarding you a barnstar or leaving other images for you. In the event that your editing privileges on Wikipedia are revoked, a notice of this may be placed on your user page. If you want to dual-license your contributions under an additional license or declare them all public domain, you may put a notice to this effect on your user page. Because of the large templates and long category names, some editors move the license templates to a subpage (see the What about user subpages? section below). Whether you include an explicit license statement or not, however, all of your edits on Wikipedia are also licensed under the GNU Free Documentation License. Many users include mentions of the languages they know (see Wikipedia:Babel). You are welcome to include a link to your personal home page, although you should not surround it with any promotional language."

While some editors admit even without humor that they are sick with this or that disease, gay or lesbians, etc., all the parts of my User page are aimed to correct, rectify and to tell editors, who I am. Florentino Floro, if read just that, will inform readers that I am psychotic, etc. But, precisely, I submitted Wikipedia Wiki links and reliable sources, to inform editors and even article readers, that I am sane, healthy, and had passed all mental tests. Just that, with the hope, that articles and edits I created, if read by readers-researchers, will not be perturbed or mislead by the contents of Florentino Floro. TLDR applies to articles, since readers might instead junk Wikipedia and read Britannica. But editors' userpages are designed by Wikipedial policy to inform editors mainly, and readers also, about the contributor.

Consensus on my User Page

[edit]

Floro's userpage is fine

[edit]

I am glad that at the very least, diligent, honest and hard-working great Wikipedian editors - GREAT, I say, since, I am just a dwarf to their contributions - had checked, verified and found no violations of Wikipedia policies and rules on the creation of my User Page, to wit:[41]

  • I believe that Florentino floro's userpage is completely fine, and without reading this entire conversation, I just want to say that I don't see why anything needs to change. I would suggest that the editors who may have been harassing and stalking Floro would get back to building an encyclopedia. The userpage is very nice, and it's nice to read about what other users have done -- that's why we have userpages. « Diligent Terrier [talk] 20:30, 26 September 2008 (UTC)
  • Yes, I agree, it seems that the same users keep trying to find more and more invalid complaints to raise against Florentino Floro. When one fails, they just look for another and keep pressing against him. This is not an accusation of bad faith on the part of these people, just a recommendation that they take more caution in the critiques they make. Algabal (talk) 02:56, 27 September 2008 (UTC)
  • I disagree (to Max's comment). Floro's page is elegant and acceptable: it helps us understand his perspective. Algabal (talk)
  • Well said, images are important in the wiki community and life. Copyright laws can be confusing and can get alot of people into trouble simply because they dont know what theyre doing, annoying on wikipedia since we have to be neutral. Congratulations on your barnstar. Thanks, RoyalMate1 00:22, 30 August 2008 (UTC)"

Conclusion

[edit]

"After reading through the evidence, opinions, and diffs of the RfC[43], I have come to the following conclusion. User:Florentino Floro is noted to make sure the additions he adds to articles satisfy the guidelines of WP:N. If they don't satisfy WP:N and are trivial additions, do not get annoyed if they are removed, remember that we are building an encyclopedia. I ask that when Florentino makes explanations on talk pages of his opinions or editing patterns, to keep them pithy, and not not write statements that take 10-15 minutes to read (we are volunteers after all). The dispute between ser:Maxschmelling and Florentino is very evident, and I strongly urge the two to avoid direct confrontation if they can. While there is no consensus on how problematic the behavior of Florentino floro is, I urge him to take the constructive aspects of his dissenters to heart and try to make himself a better Wikipedian. Lastly, I urge User:Diligent Terrier and Florentino to work together more as adoptee and adopter. I would not like to see this go to the Arbitration Committee, so hopefully we can all become better users from this.
